These Terms of Service govern your access to and use of the Lucky Mushroom website, marketplace, seller tools, buyer tools, and related services.
By creating an account, purchasing products, selling products, or otherwise using Lucky Mushroom, you agree to these Terms.
Marketplace Role
Lucky Mushroom operates an online marketplace connecting buyers with independent sellers, including foragers, cultivators, specialty producers, artists, and merchandise sellers.
Unless specifically stated otherwise, marketplace sellers are independent businesses or individuals and are not employees, agents, or representatives of Lucky Mushroom.
User Accounts
Users are responsible for providing accurate information, maintaining account security, and keeping account information current.
Lucky Mushroom may restrict, suspend, or terminate accounts that provide false information, misuse the marketplace, violate marketplace requirements, or create significant safety, fraud, or compliance concerns.
Seller Eligibility and Verification
Seller requirements may vary depending on seller type, product, location, harvest source, production method, processing activity, and other applicable circumstances.
Sellers may be required to provide permits, licenses, certificates, authorizations, insurance documentation, business information, food-safety documentation, or other records before receiving access to certain marketplace features.
Lucky Mushroom may approve or reject marketplace access, request additional documentation, or restrict access when required information is incomplete, expired, or cannot be verified.
Lucky Mushroom verification is an internal marketplace review. Verification does not constitute legal advice, government certification, or a guarantee that a seller, product, permit, license, insurance policy, or activity complies with every applicable law.
Seller Responsibilities
Sellers are responsible for complying with laws, regulations, permits, licenses, and authorizations applicable to their activities and products.
Sellers are responsible for maintaining accurate and current verification information and appropriate insurance for their business or activities when applicable.
Lucky Mushroom does not currently provide insurance coverage for marketplace sellers.
Sellers must accurately identify their products and provide truthful information regarding species, harvest date, production date, origin, quantity, price, condition, and other information required by Lucky Mushroom.
Fresh Mushroom Quality Standard
Fresh mushroom products offered through Lucky Mushroom must be no more than three days from harvest at the time of purchase.
Products older than three days from harvest may not be sold as fresh mushroom products through the marketplace.
Sellers must accurately record the harvest date for applicable fresh mushroom lots. Sellers may not falsify, alter, or intentionally conceal harvest information.
Product and Lot Traceability
Lucky Mushroom may require lot-level information including mushroom species, harvester or producer, harvest date, general origin, quantity, quality grade, harvest source, and other information necessary for marketplace traceability.
Sellers are responsible for ensuring that information submitted for each lot is accurate.
Product Listings
Sellers may only list products eligible for sale through Lucky Mushroom.
Lucky Mushroom may remove, restrict, pause, or reject a listing when required information is incomplete, verification documentation has expired, the product does not meet marketplace standards, or continued sale creates reasonable safety, quality, legal, or marketplace concerns.
Processed and Value-Added Products
Processed, dried, preserved, packaged, manufactured, or otherwise value-added food products may require additional information, licenses, permits, or marketplace review.
Sellers are responsible for satisfying requirements applicable to their products and activities.
Payments and Seller Payouts
Lucky Mushroom uses third-party payment providers, including Stripe, to process marketplace payments and seller payouts.
Sellers may be required to complete identity, banking, or payout verification before receiving marketplace earnings.
Additional payment-provider terms and requirements may apply.
Orders and Fulfillment
Sellers are responsible for fulfilling accepted orders accurately and promptly.
Sellers must provide accurate order, fulfillment, shipment, pickup, or delivery information when required.
Refunds, disputes, payment holds, and other transaction issues may be handled according to Lucky Mushroom marketplace policies and applicable payment-provider requirements.
Buyer Responsibilities
Buyers are responsible for providing accurate account, payment, shipping, and delivery information.
Commercial buyers may be required to provide additional business, resale, tax, food-service, or other information when applying for professional marketplace privileges.
No Guaranteed Sales or Income
Lucky Mushroom does not guarantee sellers any particular amount of revenue, sales volume, buyer traffic, demand, profit, or business results.
Marketplace Quality and Safety
Lucky Mushroom may establish and enforce marketplace requirements relating to freshness, quality, traceability, verification, documentation, and product eligibility.
Lucky Mushroom may investigate complaints and restrict products or accounts when reasonably necessary to protect marketplace participants or marketplace integrity.
Prohibited Conduct
Users may not provide false, fraudulent, misleading, or intentionally incomplete information.
Users may not sell unlawfully harvested, stolen, counterfeit, prohibited, or unsafe products.
Sellers may not misrepresent a product's species, age, origin, harvest date, certification, quantity, or condition.
Users may not submit falsified permits, licenses, certificates, insurance records, or other verification documents.
Users may not use Lucky Mushroom for fraudulent or unlawful activity or interfere with the security or operation of the marketplace.
Intellectual Property
Sellers are responsible for having the legal right to use photographs, artwork, designs, trademarks, brands, product descriptions, and other intellectual property included in their listings.
Taxes
Users are responsible for their own tax obligations except where Lucky Mushroom or another marketplace service provider is legally required to collect, report, or remit applicable taxes.
Third-Party Services
Lucky Mushroom uses third-party services for functions including authentication, payments, payouts, hosting, communications, shipping, and other marketplace operations.
Use of these services may also be subject to the provider's own terms and policies.
Marketplace Availability
Lucky Mushroom does not guarantee uninterrupted website operation, continuous product availability, specific seller performance, specific buyer activity, or particular financial results.
Limitation of Liability
To the extent permitted by applicable law, Lucky Mushroom is not responsible for indirect, incidental, special, consequential, or punitive damages resulting from marketplace use, transactions between marketplace participants, third-party services, or circumstances outside Lucky Mushroom's reasonable control.
Nothing in these Terms excludes or limits liability where doing so is prohibited by applicable law.
Suspension and Termination
Lucky Mushroom may suspend or terminate marketplace access when a user violates these Terms, provides false information, fails applicable verification requirements, allows required documentation to expire, creates significant safety or fraud concerns, or otherwise presents a material risk to the marketplace.
Changes to These Terms
Lucky Mushroom may update these Terms as the marketplace, services, or operating requirements change.
Updated Terms may be posted on this page with a revised effective date.
